These factors include the length of the marriage, the health of both spouses, the age and needs of each spouse, each spouse’s income and ability to earn money, and the standard of living during the marriage.

Common Grounds for Divorce

The judge will consider the assets each party has, including their pension, retirement accounts, investments, and savings. They will also consider the spending habits of each spouse. For example, if Bob spends all his disposable income on expensive clothes and meals out, the judge may not consider him to have the resources to pay alimony. A judge will also look at whether a person is acting in good faith. For example, if Bob quits his job to grow mushrooms, the judge might not be convinced that it is in good faith.
